Terms of Service

1. Overview
These Terms of Service (“Terms”) govern your use of thebrick.ai and any related services operated by The Tokenry, Inc. (“The Tokenry,” “we,” “us”). The Otto is currently available for preorder only and has not yet shipped. By placing a preorder or using our website you agree to be bound by these Terms. If you do not agree, do not use our services.
2. Preorder & Payment
When you reserve an Otto, a $29 USD non-refundable deposit is charged immediately through Stripe, our third-party payment processor. This deposit reserves your unit at the $349 USD first-run price. We currently estimate shipping to begin in Summer 2026, but this date is not guaranteed and may change.
Before your Otto ships, we will email you to confirm your shipping address and final total. You will have 7 days to adjust your order before we charge the remaining balance ($349 minus your deposit), applicable tax, and $15 USD flat domestic shipping through Stripe. Shipping is not included in the $349 device price. For international orders, we will contact you before shipment if extra shipping charges apply, and carrier or import costs may be due on delivery.
A reservation secures your place in our production queue and locks in the first-run price. During checkout, we also collect your shipping address so we can calculate and communicate your shipping cost when production is complete.
3. Cancellation & Refunds
Before your Otto ships
Your deposit is non-refundable. Before your remaining balance is charged, you may update or cancel the rest of your order by emailing us at the address listed below, but the deposit will not be refunded. If the estimated ship date changes by more than 6 months from the date shown at the time of your order, we will notify preorder customers of the updated timing.
After delivery
You may return your Otto within 14 days of delivery. The device must be in its original condition and packaging. Shipping costs for returns are the responsibility of the buyer, and a 15% restocking fee will be deducted from your refund. After 14 days, all sales are final.
4. Product Description
The Otto is a dedicated hardware device designed to run always-on AI agents. The planned configuration includes OpenClaw pre-installed, a hardened Linux build, 8 GB RAM, 128 GB SSD, and an NFC chip for phone pairing. Because the Otto is in preorder and not yet in production, hardware specifications, included software, and features may change before the final unit ships. We will notify preorder customers of any material changes.
The Otto is a general-purpose Linux computer. While it is optimized for running AI agents, you are free to use it for any lawful purpose. Nothing is locked down.
5. OttoOS App & Services
OttoOS is a planned companion app that will provide messaging, integrations, and observability for agents running on your Otto. OttoOS is currently in development and is not yet available. Use of the app will not be required to operate the hardware.
When OttoOS launches, we anticipate the following pricing structure:
- Usage-based— LLM costs are passed through at our current margin, which we may adjust with at least 30 days' notice.
- Bring your own keys — If you supply your own API keys, app access is a flat $29/month.
This pricing is projected and may change before launch. Once OttoOS is available, we will provide at least 30 days' notice before any pricing changes.
6. Acceptable Use
You agree not to use The Otto or OttoOS to:
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Distribute malware, spam, or engage in phishing
- Harass, threaten, or harm any individual
- Attempt to gain unauthorized access to any system or network
We reserve the right to suspend or terminate access to OttoOS services for violations of this policy. The hardware itself remains yours regardless.
7. Limitation of Liability
To the maximum extent permitted by law, The Tokenry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Otto or OttoOS.
Our total liability for any claim arising from these Terms or your use of our products shall not exceed the amount you paid to us in the twelve months preceding the claim.
The Otto runs third-party software including OpenClaw and cloud-based LLM services. We are not responsible for the actions, outputs, or failures of AI agents you deploy, nor for the availability or performance of third-party APIs and services.
The Otto is offered as a preorder product. We make no warranty, express or implied, regarding the final production timeline, specifications, or fitness for a particular purpose until the product has shipped. Preorder customers assume the risk that the final product may differ from current descriptions.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Thurston County, Washington.
9. Modifications
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
